Contracts and Titles

What are the contracts related to purchasing a unit and when can I expect them?

 

 

You can expect the following contracts and within the following timelines:

1.     Contract to Sell (CTS)

The CTS will be prepared within five (5) days from the time that all CTS requirements have been submitted and endorsed for preparation. Documents should be sent back within fifteen (15) days for local buyers / sixty (60) days for international buyers. Your copy of the notarized CTS will be released after forty-five (45) to sixty (60) days, or as soon as the documents have been confirmed and notarial services are done. The CTS will come with a:

  • Cover Letter
  • Final Payment Schedule / Annex A:

The Final Payment Schedule is the officialized document of your Sample Payment Schedule upon signing. This will ultimately show your exact payment scheme.

  • Master Deed of the Declaration of Restrictions (MDDR):

The acknowledgement of the MDDR must be given by signing all pages, including its annexes.

2.     Deed of Absolute Sale (DOAS):

The Deed of Absolute Sale is released within two to three (2-3) days after the account is fully paid and handover fees are fully settled. You may opt to pick up the document personally or by your Property Specialist from the Head office, or have it sent thru a courier. The signed and returned DOAS will be notarized by Ortigas Land.

3.     Title / Certificate of Ownership:

The Title is equivalent to the Certificate of Ownership. Titles can be called a Transfer Certificate of Title / “TCT” (for lots) or a Condominium Certificate of Title / “CCT” (for condo units and parking slots). Parking Slots will also come with a separate Title. The Title is usually released within nine to twelve (9-12) months from the time DOAS is returned.

How do I change the details in the contracts?

 

 

For any change of details in the contract, the following requirements have to be submitted:

Requirements for each type of change requested to be submitted in addition to the above items:

Change in ADDRESS

1. Principal Address

  • Photo /electronic copy of Proof of Billing (POB)

2. Mailing Address

  • Photo /electronic copy of Proof of Billing (POB)
  • No need for a redocumentation fee

Change in CITIZENSHIP

  • Photocopy of Oath of Allegiance
  • Photocopy of valid Passport ID

Change in CIVIL STATUS

1. Single to Married

  • Tax Identification Number of Spouse
  • Photocopy of Marriage Certificate

2. Annulled

  • Photocopy of Court Decree of Annulment /Declaration of Nullity of Marriage

3. Widowed

  • Photocopy of Death Certificate of deceased spouse
  • Extra-Judicial Settlement: Estate Tax Settlement (proof of payment /tax clearance from BIR) and Certificate Authorizing Registration (CAR)

How do I Add or Remove Co-Owners?

 

 

To add or remove co-owners, kindly prepare the following requirements:

Requirements for Adding Co-Owners:

  1. Signed Buyer’s Request Form
  2. Fully accomplished and Reservation Agreement of the new co-owner/s including spouses
  3. Signed Request Letter from the principal buyer indicating that he/she will add a co-owner to the property.
  4. Photocopy of two (2) valid government-issued ID (with 3 specimen signatures) of the new co-owners including their spouses
  5. Tax Identification Number of new co-owners including their spouses
  6. Photocopy or Electronic copy of Proof of Billing (POB)
  7. Photocopy of Marriage Certificate (only if applicable)
  8. Payment of PHP 20,000 redocumentation fee

Requirements for Removing Co-Owners:

  1. Signed Buyer’s Request Form
  2. 2 sets of fully accomplished and Notarized Deed of Assignment of Rights (the Deed of Assignment of Rights template will be provided upon request.
  3. Fully accomplished and signed Reservation Agreement of the retained and new buyer/s
  4. Signed Request Letter from the principal buyer notifying Ortigas Land that he/she will remove their co-owner/s in the property
  5. Photocopy of 2 valid government-issued ID (principal buyer and spouse if any)
  6. Photocopy or Electronic copy of Proof of Billing (POB)
  7. Payment of PHP 20,000 redocumentation fee

How do I go about Transfer of Ownership?

 

 

To transfer ownership, kindly prepare the following requirements depending on the type of transfer:

From INDIVIDUAL to INDIVIDUAL

  1. Signed Buyer’s Request Form
  2. Two (2) Notarized / Consularized / Apostille Deed of Assignment of Rights
  3. Fully accomplished and signed Reservation Agreement
  4. Photocopy of two (2) valid government-issued IDs of all new owners
  5. Photocopy or Electronic copy of Proof of Billing (POB)
  6. Tax Identification Number of all new owners including co-owner/s and spouses
  7. Photocopy of Marriage Certificate (only if applicable)
  8. Payment of Transfer Fee (varies per project)

From INDIVIDUAL to CORPORATION

  1. Signed Buyer’s Request Form  
  2. Two (2) Notarized / Consularized / Apostille Deed of Assignment of Rights
  3. Fully accomplished and Reservation Agreement
  4. Photocopy of two (2) valid government-issued ID of the authorized signatory/ies
  5. Notarized Secretary Certificate / Board Resolution
  6. Photocopy or Electronic copy of Proof of Billing
  7. Tax Identification Number of the authorized signatory/ies
  8. Articles of Incorporation / Partnership / Association and By-laws
  9. Business Registration / DTI / Sec Registration
  10. Certificate of Registration
  11. The General Information Sheet (one of the documents required to be submitted to the Securities and Exchange Commission every year and the documents should be certified and sworn to by the corporate secretary).
  12. Payment of Transfer Fee (varies per project)

From CORPORATION to CORPORATION

  1. Signed Buyer’s Request Form
  2. Two (2) Notarized / Consularized / Apostille Deed of Assignment of Rights:
  3. Fully accomplished and signed Reservation Agreement
  4. Photocopy of two (2) valid government-issued ID of the authorized signatory/ies

How do I assign an Attorney-in-Fact?

Special Power of Attorney / SPA

 

 

Kindly prepare the following in order to assign/re-assign an Attorney-in-Fact:

  1. Signed Buyer’s Request Form
  2. One (1) Notarized Special Power of Attorney
  3. Signed Reservation Agreement
  4. Two (2) Valid IDs and Proof of Billing of Attorney-In-Fact
  5. Tax Identification Number of Attorney-In-Fact

Documents can be submitted personally or by your Property Specialist to the Ortigas Land Head Office: 7F Estancia East Wing, Capitol Commons, Meralco Avenue, Pasig City 1605, Philippines.

When can I pick up the Title and who else can receive it on my behalf?

 

 

The Title transfer will be processed for you by Ortigas Land once the Deed of Absolute Sale has been submitted. The process usually takes around nine to twelve (9-12) months. You will be contacted once the Title is ready for pick up. Delivery through courier, messenger, etc. is highly discouraged to avoid loss or damage of the document/s while in transit.

Only the registered owner, co-owner, or Attorney-in-Fact can pick-up the Title. An original notarized Special Power of Attorney, together with the photocopy of a valid ID of the attorney-in-fact AND the client, should be submitted upon pick up of the Title if it is to be picked up by the Attorney-in-Fact.
